THE “REAXION XBOX 360” SWEEPSTAKES OFFICIAL RULES
1) PROGRAM DESCRIPTION: No purchase necessary to enter or win. The Reaxion Xbox 360 Newsletter Sweepstakes (the “Sweepstakes”) is a promotional sweepstakes where eligible entrants have the chance to win an Xbox 360. The Sweepstakes begins at 7:00 a.m. Pacific Time (“PT”) on February 1, 2007 and ends at 9:00 p.m. PT on July 29, 2007 (“Promotion Period”). The winners will be selected in a random drawing from among all eligible entries received.
This Sweepstakes is conducted in the United States of America (USA), and all entry information is collected on computers located in the USA.
2) HOW TO ENTER: Registration: Access one of the Reaxion websites at www.reaxion.com or www.gamarama.com during the promotional period and complete the official Registration Form. To be eligible, Entrants will be required to provide their name and e-mail address and to create a Username and Password to be used for subsequent visits to Reaxion.com. Entrants must also sign-up for Reaxion’s Newsletter, the Reaxion Flash “Newsletter”.
Limit one (1) Registration per person per household. Subsequent Registrations submitted by a single entrant or e-mail address for the purpose of a single user participating multiple times through each account will be disqualified. Proof of submission of entry does not constitute proof of delivery. “Releasees” (as defined below) assume no responsibility for lost, late, illegible, garbled or misdirected entry materials, or for any computer, online, telephone, human, or other error or for any technical or other malfunctions that may occur. No mechanically reproduced, illegible, incoherent, unusable, or incomplete entries will be accepted.
3) WINNER SELECTION: the Winner will be selected from all eligible entries received in a random drawing to take place on July 30, 2007 at 10:00 a.m. (PT). The prize winner will be notified on or around August 1, 2007 via the email address provided in his or her newsletter sign-up form. The Sponsor (or their authorized representative) will make two (2) attempts to reach the potential Grand Prize winner. If the potential Grand Prize winner cannot be reached or refuses the prize, that individual will be disqualified and an alternate winner will be selected. The Sponsor will continue to make two (2) attempts to reach any alternate winner selected. The potential winner will be required to execute and return by fax and/or overnight delivery service an affidavit of eligibility/release of liability within twenty four (24) hours following receipt of same. Sponsors will provide overnight courier envelope to the potential winner to return the required documentation within twenty four (24) hours following receipt of same. Non-compliance with this time period may result in disqualification and selection of an alternate winner.
Non-compliance with the time periods and procedures for return of affidavits, with these Official Rules or return of any notification as undeliverable may result in disqualification and, at Sponsor’s discretion; prize may be awarded to an alternate winner.
4) PRIZES: One (1) Xbox 360 gaming console. Total Approximate Retail Value (ARV) of prize: $399.
5) ELIGIBILITY: This sweepstakes is open to United States residents, 18 years or older. Employees of Reaxion Corp and persons living in the households of Reaxion employees are not eligible to enter.
6) GENERAL CONDITIONS: Entrants agree to be bound by the terms of these Official Rules. Sweepstakes shall be governed by the laws of the State of Washington, USA, and participants hereby consent to the exclusive jurisdiction and venue of Washington courts (state and federal) for any cases or controversies arising out of the Sweepstakes. Any dispute arising out of or relating to the Contest shall be settled by arbitration in Seattle, Washington, administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules including the Optional Rules for Emergency Measures of Protection, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. By entering, participants release and hold harmless Reaxion Corp and its respective subsidiaries, affiliates, advertising and promotion agencies, prize suppliers, and all of their employees, officers, directors, shareholder’s and agents (collectively, “Releasees”) from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Sweepstakes, the use of any entry, or the acceptance or use of any prize won.
7) INTERNET: The use of any automated means that permits the participant to automatically enter repeatedly is prohibited. If for any reason this sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Reaxion Corp. which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Reaxion Corp reserves the right at its sole discretion, to disqualify any entry or any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes and select a winner using all eligible, non-suspect entries received as of the date of termination. Releasees assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Releasees are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, REAXION CORP RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
8) WHO WON: To receive name of the winners, mail a self-addressed stamped envelope to: Reaxion “Xbox 360 Newsletter” Winners 2200 Sixth Ave Suite 260, Seattle, WA 98121-1846. Mail-in requests received after August 30, 2007 will be disregarded.
9) SPONSOR: The Sponsor of this sweepstakes is Reaxion Corp, 2200 Sixth Ave Suite 260, Seattle, WA 98121-1846.
